1. Identification and purpose
The Snurkel app and the snurkel.com website are owned by CLOUDANA SOLUTIONS, S.L. (“Snurkel”), with tax ID B-67146324 and registered address at Avinguda Bon Pastor 15, 08380 Malgrat de Mar (Barcelona); email info@snurkel.com. These terms govern access to and use of the service. By using Snurkel you accept these conditions.
2. User account
You must be over 14 years old and provide truthful, up-to-date information. You are responsible for keeping your credentials confidential and for all activity carried out from your account.
3. User content
Snurkel is a geolocated news and posts service created by its community. You are solely responsible for the content you publish and warrant that you have the right to share it. Unlawful, false, defamatory content, content inciting hatred or violence, infringing third-party rights or breaking the law is prohibited.
By publishing, you grant Snurkel a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content within the service in order to provide it. You retain ownership of your content and may delete it at any time.
4. Third-party content and intellectual property
Snurkel also works as a news aggregator. Alongside community content, the app shows headlines taken from syndication feeds (RSS/Atom) published by town halls and news outlets themselves, who make those feeds publicly available precisely so they can be distributed.
- Short extracts only. For each item we show the headline and a short extract (300 characters maximum) taken from the syndication feed itself. We do not reproduce the full article or host copies of the original piece.
- Attribution and link. Every news item identifies its source outlet or public body and includes a link to the original publication, where the full content can be read.
- Third-party ownership. Headlines, texts, trade marks and images belong to their respective owners. Snurkel claims no rights over that content and does not present it as its own.
- Public sector information. Many sources are town halls and other public bodies; their information is reused in accordance with Spanish Law 37/2007 on the reuse of public sector information and with the conditions each body sets.
- No advertising exploitation. We do not insert our own advertising inside third-party items, nor do we directly monetise their content.
This use relies on the limits laid down by law for hyperlinks and very short extracts — Article 15 of Directive (EU) 2019/790, implemented in Spain by Royal Decree-Law 24/2021 — and on the quotation and current-affairs reporting rights of the Spanish Intellectual Property Act. If you are a rights holder and do not wish to appear, we will handle your request under the following section.
5. Content removal and rights-holder requests
We respect the wishes of any outlet, public body or rights holder that does not want to appear on Snurkel. There is a free, informal procedure to request removal or exclusion.
- How to request it: write to info@snurkel.com stating the URL of the item or the name of the source, and the capacity in which you act (rights holder or representative).
- Removal of a specific item: we delete it from the app.
- Full exclusion of a source: we disable its feed and stop showing any content from it, with no justification required.
- Turnaround: we handle requests as quickly as possible and, in any event, within a maximum of 72 working hours from receipt.
- No strings attached: exclusion is immediate, free of charge and subject to no consideration whatsoever.
Snurkel acts as an intermediary service provider under Spanish Law 34/2002 (LSSI) and Regulation (EU) 2022/2065 (Digital Services Act): we do not pre-screen the content distributed by the sources and we act diligently as soon as we obtain actual knowledge of unlawful content or of a legitimate removal request.
6. Moderation
We may remove content and suspend or cancel accounts that breach these terms or applicable law. If you spot inappropriate content, you can report it from the app or by writing to info@snurkel.com.
7. Acceptable use
- Do not impersonate others or spread information you know to be false.
- Do not use the app for harassment, spam or unauthorised commercial purposes.
- Do not attempt to gain unauthorised access to Snurkel’s systems or alter its operation.
8. Liability
Snurkel is provided “as is”. We do not guarantee the accuracy or truthfulness of content published by users, nor uninterrupted availability of the service. To the extent permitted by law, Snurkel is not liable for damages arising from use of the service or from third-party content. None of the above limits the rights granted to you as a consumer.
9. Governing law and jurisdiction
These terms are governed by Spanish law. If you act as a consumer, the courts of your place of residence have jurisdiction: no clause in these terms may deprive you of that protection. Where you do not act as a consumer —for example, if you use Snurkel in the course of a business or professional activity—, the parties expressly submit to the Courts of Barcelona (Spain), waiving any other jurisdiction that might otherwise apply.
